Google Cloud 商用エンタープライズ契約に基づく「学習非利用（No-Training）」完全保証

SPOON（davinci, Inc.）では、国際規格 ISO/IEC 42001（AIMS）および経済産業省・総務省「AI事業者ガイドライン」に準拠し、作家様の作品データおよび個人情報の尊厳を最優先で保護しています。お預かりした作品写真、解説文、ステートメントがAIモデルの再学習（トレーニング）に流用されることは契約上100%遮断されています。

1. 基本方針

davinci, Inc.（以下「当社」）は、提供するWebポートフォリオ生成サービス「SPOON」（以下「本サービス」）において、お客様の個人情報の保護を事業運営上の最重要責務と認識し、個人情報の保護に関する法律（個人情報保護法）および関連法令・規範を遵守して、適正な取り扱いと安全管理を徹底いたします。

2. 取得する情報

当社は、本サービスの提供にあたり、以下の情報を取得いたします。

  • お客様の連絡先情報: 作家名（本名または活動名）、メールアドレス、電話番号等
  • 展示・入稿データ: 作品画像（JPEG, PNG, WebP等）、作品タイトル、キャプション、作家ステートメント、プロフィール情報、外部リンクURL、音源・動画データ等
  • 決済情報: クレジットカード情報は世界基準の決済基盤 Stripe（PCI-DSS Level 1）により直接暗号化・トークン化処理され、当社のサーバーにカード番号が保持されることはありません。
  • アクセス解析情報: クッキー（Cookie）、IPアドレス、ブラウザ種別、アクセスログ等（Googleアナリティクスによる利用状況の統計的把握を含みます）

3. 情報の利用目的

当社は、取得した個人情報を以下の目的の範囲内でのみ利用いたします。

  • Webポートフォリオ空間の生成、校閲、スタイリング、およびプレビュー・本番納品
  • ご注文の確認、決済手続きの完了確認、および関連する事務連絡
  • お客様からのお問い合わせ対応、およびアフターサポートの提供
  • 本サービスの品質向上、アクセス動向の分析、およびシステム改善

4. AIデータ保護憲章（No-Training保証）

① 作品データの再学習（トレーニング）完全不使用

当社はGoogle Cloudのエンタープライズ商用API契約を採用しています。利用規約（Enterprise Terms）に基づき、ご入稿いただいたすべてのデータ（写真、解説、ステートメント）がAIベンダーの基盤モデルの追加学習や機能改善に二次利用されることは契約上固く遮断されています。

② 著作権の完全帰属

作家様からご提出いただいた作品画像、文章、音楽等の著作権および著作者人格権は100%作家様に帰属します。当社が著作権を主張することや、許可なく第三者へ譲渡・販売することは一切ありません。1500時間の公開終了・消滅後も権利は完全にお手元に残ります。

③ 人間による品質・権利確認（Human-in-the-Loop）

AIによる日英翻訳やレイアウト案は「初期草案」としてのみ扱い、無検証のまま公開されることはありません。必ず専任ディレクターが実機で目視検証を行い、作品の尊厳を損なわない品質を担保した上で納品いたします。

5. 第三者提供の制限

当社は、法令に基づく裁判所・警察等からの要請がある場合を除き、お客様の事前の同意を得ることなく個人情報を第三者に開示・提供することはありません。

6. 安全管理措置

個人情報の紛失、破壊、改ざん、漏洩および不正アクセスを防止するため、通信の常時暗号化（SSL/TLS）、厳格なアクセス制御、および最小限の権限付与による安全管理措置を講じています。

7. 個人情報の開示・訂正・利用停止

お客様ご自身の個人情報の開示、訂正、追加、削除、または利用停止をご希望される場合は、ご本人確認の上、合理的な期間および範囲で速やかに対応いたします。下記窓口までご連絡ください。

Google Cloud Enterprise Commercial Terms: Strict "No AI Training" Guarantee

davinci, Inc. complies with international ISO/IEC 42001 (AIMS) standards and AI Governance guidelines to prioritize and protect the dignity of creators' works and personal information. Under our enterprise agreement, submitted artwork images, statements, and bios are 100% prevented from ever being repurposed for AI model retraining.

1. Fundamental Policy

davinci, Inc. ("the Company") recognizes the paramount importance of safeguarding personal information in operating "SPOON" (the "Service"). We strictly adhere to applicable data privacy laws, maintaining rigorous security safeguards and transparency.

2. Information We Collect

We collect the following categories of data to provide the Service:

  • Contact Information: Artist name (legal or pseudonym), email address, phone number.
  • Exhibition & Portfolio Materials: Artwork files (JPEG, PNG, WebP), titles, captions, artist statements, bio texts, external URLs, audio and video files.
  • Payment Details: Credit card transactions are tokenized and processed directly by Stripe (PCI-DSS Level 1). We do not store card numbers on our servers.
  • Technical & Analytics Data: Cookies, IP address, device/browser details, and access logs collected via Google Analytics (GA4) to understand service usage.

3. Purpose of Use

We utilize personal data strictly for the following purposes:

  • Building, curating, translating, and delivering bespoke web portfolio spaces.
  • Order confirmation, transaction verification, and administrative communications.
  • Customer support, inquiries, and post-delivery assistance.
  • Service refinement, reliability monitoring, and website improvements.

4. AI Data Charter (Strict No-Training Guarantee)

① Zero Model Retraining

We operate under Google Cloud enterprise commercial agreements. By contract, all submitted creator data (images, statements, audio) is strictly isolated and NEVER used to retrain foundation models or improve AI vendor services.

② 100% Artist Copyright Ownership

All copyright, moral rights, and intellectual property remain 100% with the artist. We make no ownership claims and never sell or license your creations to third parties. Rights persist in your possession even after the 1,500-hour exhibition dissolves.

③ Human-in-the-Loop Quality Review

AI translations and layout structures are treated solely as preliminary drafts. Our lead human director inspects each detail on real devices before delivery to preserve artistic dignity.

5. Third-Party Sharing Restrictions

We do not sell, rent, or disclose personal data to third parties without prior explicit consent, except when legally mandated by court orders or governmental authorities.

6. Data Security Measures

We enforce comprehensive technical safeguards including continuous SSL/TLS encryption, least-privilege access controls, and regular audits to prevent data breaches or unauthorized access.

7. Rights of Access, Rectification & Deletion

You hold the right to request access, correction, or deletion of your personal records. Upon identity verification, we will respond promptly within a reasonable timeframe.
